Trump seeks to block Pence's grand jury testimony in 2020 election interference probe

CNN — Former President Donald Trump has asked a federal court to block former Vice President Mike Pence from speaking to a grand jury about certain matters covered by executive privilege as part of the criminal investigation into efforts to overturn Trump’s 2020 election loss, sources familiar with the move told CNN.

The request, in a new filing submitted secretly in a sealed proceeding on Friday, comes after the Trump team had already indicated to special counsel Jack Smith, who is overseeing the Justice Department’s criminal investigations into Trump, that the former president intended to assert privilege over Pence’s testimony.

The DOJ had previously asked a judge to compel Pence’s appearance before the grand jury, CNN reported last week. It is unclear how long it will take for the sealed proceedings to unfold, but it’s possible that the district court resolves the dispute, or that it will be appealed to a federal appeals court and perhaps, eventually, to the US Supreme Court.

Since taking over the DOJ investigation into efforts to overturn the 2020 election, Smith, who has a reputation for moving quickly, has accelerated the probe’s pace. The grand jury subpoena that has been issued to Pence seeks documents and testimony related to the events of January 6, 2021, when the US Capitol was attacked by pro-Trump rioters as Congress prepared to certify the 2020 election results.

on North Vietnam. I didnt know any better; just that an atomic bomb made Japan surrender. My dad had to explain to me why "the bomb" wasnt just a bomb that was bigger than any OTHER bomb.

it's better that Trump does not face justice. One, there is no risk of him being found innocent. Remember, for Trump, a "not guilty" verdict means he's innocent. Like he is for all his other crimes. Two, by not having to face justice, the sentences meted out to his insurrectionist supporters are even more egregious. And as far as the justice system goes, Trump and his like are special.

For one thing, a conviction - any conviction - would preclude him from ever running for high office again. I really don't care what the ChumpHumpers think or how they feel. That's totally irrelevant. Once he's convicted he's done.

Chump has already admitted his guilt, but not under oath. He discussed his plans to break the law with several people including Mike Pence. Pence heard the entire plan for January 6th, and to Mike's credit he recognized what clusterfuck the whole thing was. Others can also testify against Chump and prove him guilty, for example Mark Meadows, Rudy Giuliani and several of Chump's own family members.

Once Chump is indicted - and he will be - it's the first step and we'll have a monumental, historic trial and possibly it will be several trials. I find it hard to believe that the legal proceedings against Chump will all end with him getting "not guilty" decisions. I doubt that he'd get convicted on everything, but all it takes is ONE conviction.

Sentencing will be a different matter and lots of conflicted feelings there too. I'm thinking that at least some federal judges would refrain from giving Chump prison time, it may end up being some kind of "house arrest" situation. I don't know, and I won't make any predictions in that regard.

Make no mistake, Chump will be indicted.

Being seen as a failure would be a worse punishment for a thing like him. Putting him in jail makes him a martyr. Unless he's executed for treason, then even if he's a martyr he's a dead one.

Pence has a unique role in the election certification process that is independent of his duties as an executive department employee. How then would Trump be able to invoke Executive Privilege? Also, there is an Executive Privilege exclusion in matters criminal in nature. Indeed, hasn't Trump already lost 1 case involving the exclusion?
