Trump seeks to use NY hush money trial to delay criminal case over classified document handling in FL

Source: CNN Politics

CNN — Former President Donald Trump is using his first criminal trial, set to begin Monday in New York, to try to delay facing a jury over more serious federal charges in Florida. In the latest effort to capitalize on the colliding court schedules, Trump asked US District Judge Aileen Cannon on Saturday to push back a May deadline for reviewing classified evidence in the criminal case over his alleged mishandling of classified and sensitive government information stored at his Mar-a-Lago estate.

Trump can’t meet the deadline, his lawyers said in a filing, because he’ll be on trial for state charges in Manhattan. That trial — over allegations that Trump falsified business records to conceal hush money payments to cover up an alleged affair with an adult film star before the 2016 election — could last into June.

But Trump and his primary defense lawyers, Todd Blanche and Emil Bove, can’t be in two places at once, they said. “President Trump has a constitutional right to be present at the trial in New York and, as a result, cannot participate in this work relating to important parts of his defense,” Trump’s attorneys wrote in the filing to Cannon.

As the former president’s legal team steps into the Manhattan courtroom Monday, work in the Mar-a-Lago documents case will grind to a near-total halt. The classified documents case has stalled in Florida federal court, and Trump’s defense team has already dramatically reduced the amount of time they’ve spent working on the criminal case over the last six weeks. Cannon, who is overseeing the case, has not yet set a trial date, has few other deadlines on the calendar and has a backlog of legal disputes she has yet to resolve.

Cannon would sit on it anyway, ( unless cannon tries to screw up everything)the Georgia trial could go, after the STUPID SC decides stupid immunity.decision. Cannon will try to mess everything up, if she could.

He was ordered to be present. Do defendants normally get to skip out on their felony trials?

She has been busy scribbling "Aileen Trump" in her notebooks, so she had to break away from that to hear from her future husband and leader. She is on her knees for him. His word is her command. She is disgusting. She has as much to do with legality as trump has to do with patriotism. Just another MAGAt doing his bidding at the cost of her soul. Not sure how much history is left to live (climate change, Pootie with his nukes, and all), but if we go on, she will be highlighted as (one of the) worst examples of jurisprudence of our era. I'd ask how she sleeps at night, but I already assume it is with her head on pillow with an orange face pictured on it.

Legal team, do you have access to zoom, teams, FaceTime, or some other video conferencing app?

Can you use fed ex or other documents delivery company?

If the defendant was out traveling trying to camp, would you still rack up billable hours on his defense?

Then sit down and STFU trial goes as scheduled

After which he can go on trial in D.C. for the 1/6/21 coup attempt, Fani Willis also needs to get her shot
for Trump’s Georgia 2000 election crimes (phony electoral votes & “I need you to find me 11,870 votes”
on tape), Jack Smith has some plans for Donny, and he is facing millions of dollars more in civil lawsuits
from the US Capitol Police too.”

But as for today he has to sit in Judge Merchan’s and be “a nice boy.”

The man as of today has 91 felony charges along with @ least 1/2 billion in civil penalties.

Cheato Benito doesn't need to be present:

Rule 43. Defendant's Presence

(b) When Not Required. A defendant need not be present under any of the following circumstances:

{snip}

(3) Conference or Hearing on a Legal Question. The proceeding involves only a conference or hearing on a question of law.

https://www.law.cornell.edu/rules/frcrmp/rule_43

Since he's required to be in NY for that trial, but not in Florida for the federal trial, then an honest judge would deny the motion.

Cannon isn't honest, so don't expect her to make an honest ruling.

circumstances when the judge does not have to require his/her presence. The right is the defendant's to waive or not waive. The procedures provide that the defendant cannot waive personal attendance in some cases; however, in the absence of a waiver, very few situations allow non-consensual exclusion. They do not include absence based on a defendant's compelled attendance in another venue.

Excluding him would introduce additional delay by providing another avenue of appeal.

... someone charged with multiple felonies in multiple jurisdictions would hire enough lawyers to handle all of the cases. And a competent judge would say, too bad, so sad. Suck it up. It is not my concern that you have crimed so damn much.

But we all know this isn't a sane world. She will oblige with more delays every single time she is asked by the criminal.

Canon is already slow walking the docs trial. What’s the point here? I have to wonder if it is to give Canon more reason to delay.

We already knew there was an order of operation with these trials. AG Bragg already differed this to the 3 others. But with all of them tied up in SCOTUS appeals, that opened the door for Bragg to proceed.
