Biden remark on 'gun show loophole' spurs claim that he 'lied,' but it's true that background checks

are not always required

More than one-in-10 US gun owners have purchased a firearm without undergoing a federal background check, a loophole available to unlicensed private sellers that President Joe Biden wants to close.

"Most people don't know, you walk into a store and you buy a gun, you have a background check. But you go to a gun show, you can buy whatever you want and no background check," Biden said Thursday in an address from the White House Rose Garden.

But that is not exactly true: commercial dealers at gun shows are subject to the same background-check requirements as elsewhere. Only those private sellers - people hawking guns they personally own - can currently evade this in most of the country, with just 16 states requiring all gun sales be accompanied by an investigation into the purchaser, according to the Giffords Law Center to Prevent Gun Violence.

Conservative media pounced on Biden's generalization. "Biden Falsely Claims Background Checks Aren't Required At Gun Shows," stated the Daily Caller, a far-right website.

There will be people there that will sell or swap guns without a background check.

And the only way i've seen to purchase a gun without a background check is in the parking lot of a gun show.

But if I buy a table to sell a dozen or so guns on my own, nope, no background checks necessary. People walk around with a gun on their back and a little flag sticking out of the barrel with the price and again, no check. Just those who already are set up to check must. I don’t know the exact split, there are a lot of FFL dealers at the shows, but even if it is 90/10 or 80/20, if you know you can’t pass the background, it’s the place to go.

The gun show loophole is alive and well.

A gun show loophole is only at a gun show.

A legal condition at a gun show allowing private sellers where a felon can illegally purchase a gun from a private seller with immediate delivery and without a background check .

Gun shows have nothing to do with the issue at all, it's simply that non-dealers are not legally allowed to access NICS to perform a background check on another person. A gun show for non-dealers is no different than selling to a family member, friend, co-worker or complete stranger. Create a system where private citizens can access NICS without opening the door to identity theft and the gun show "loophole" resolves itself without having to have legislation specific to gun shows.

The only thing a gun show has to do with it is bringing people together that are looking to buy/sell a gun, it provides a market but there's nothing specific about a loophole in relation to gun shows. Dealers are mandated to perform the same checks they do in their store fronts.

Continuing to conflate gun shows with the issue only gets us called out on our ignorance, case in point.
