Various videos show how National Guard persons randomly let some and not other supporters through to the First Nations protest.

These show a bit of classic troop counterinsurgency model -- attacking civilians -- used in Indian war days: cut off supplies and help, intimidate "insurgents" with arrest and animal attack, wait them out through privation and upcoming bad weather, then go in and round them up. Maybe take them to Forts Yates or Rice, who knows. Keep surrounding populations in the dark about it all.

Our Indigenous are "insurgents" in this legally designated "battleground" (NDAA 2013) country where land base control of resources is stolen and sold.

4. So the jerk governor of the state of North Dakota

has decided to have the militia set up "check points" to prevent the media and others to have access to duly support their Constitutional right to protest and to report whats is going on, all under the First Amendment protections.

Then to have everyone running around in circles, you can't come in this way you have to go that way---------------really.

I would have asked under what "Writ" authority was obtained and what court order and to give me the name and number of the "Writ and the Order"

This is not some military exercise, that can be willy-nilly put in place, where is the court order, and who signed in on it, what is the judges name, and what "rule"

And the militia is suppose to duly protect that Constitution right, am I missing something here or what, or is there a selection process for the state militia, don't think so

It is now time to call for the Impeachment of the Governor Dalrymple III, and as for Heithkamp and Hoeven, Cramer, to find out who and what part of the oath do they operate under of the Constitution or do they have some other rendition or another form of the Constitution.

And yes I am being critical of the senators and the congressman, not one of them has said anything about this issue to the Corp and the energy company>

The Governor and the congressional delegation and there self righteous duty to continue the doctrines of Manifest Destiny and the Doctrine of Discovery are suppose to honor the treaties of 1851 & 1868, the words in the Constitution, and the 1990 Act.

Just maybe while the Congressional delegation is getting ready to take some time off, you know working only 111 days out of 365 is just so demanding in Congress and budding up to your oil and gas interest is just more important than the 206 water ways and two major rivers under threat affecting millions of animals and people, and let's not forget the Lakota and Cheyenne Sioux and other Indigenous People and there rights and your rights to have clean water and no desecration of scared ground, burial land--------------where are they, anyone from the region heard anything from them?

You know the same people making $174,000 a year working 111 days out of the year, hear anything from them, one peep?

How would they feel if the state militia was set up on the roads that lead into the place they want to live and protect---------------where are there principles----------------that's the question principles and scruples

5. Don't be so sure there's a judge behind this. An order from the gov suffices. Notice their

reticence over keeping people from "going their way." They play just-following-orders stupid while their compromised oaths to uphold the Constitution make them uncomfortable.

I read that any military person can refuse to follow what s/he deems are illegal orders. Perhaps that's why some let people drive into the camp.

There should be some lawyers and judges to challenge this governor. Where the hell are they.

You can bet that there are just enough Big Oil sellouts to not get an impeachment vote, or this Dalrymple guy wouldn't get away with this shit.

Whenever there is Indigenous People involved, this is an entirely different "ball game" to use that metaphor.

You cannot willy nilly throw the National Guard around, the governor has to get permission from the "president" , the president can tell the governor that he is going to nationalize that force to deal with a issue, it is not the other way around. look no further than this:

Just like down in Charlotte, they have to get permission, there is a chain of command to use that force.

People want to know how the federal government got involved to do this at Standing Rock, they are not suppose to be used as a private police force to protect a oil company and it's interest, that's not the purpose.

I'm not sure what you're disputing here. Lines of civilian/military/judiciary rule are fairly old and clear cut. Judges don't order anything about the military without a plaintiff of legal standing.

I'm hoping this escalates. I'm hoping the corporate fictional personhoods headed by the 26 CEO's that run this oil-for-China project get beaten badly by the organic personhoods of the Sioux and other tribes in the US/Canada areas.

These CEO's need to eat their losses and move on to above-ground green energy profit making.

12. The Guard can be called to State Active Duty

The governor has the authority to order the National Guard to State Active Duty, known under the authorizing laws as SAD, under his own authority. This can be for disasters, maintaining civil order, or for police duties. This does not require any federal authorization and is paid for by the state.

The President can prevent or override state use by activating the guard to federal duty, same command structure, just a different top boss giving the orders to the general. The costs are then covered by the federal government.

In 1957 the governor of Arkansas had called the Guard to State duty to prevent the desegregation of Little Rock schools. In that case Eisenhower sent part of the 101st Airborne, at the request of the mayor, to escort and safeguard the students. At the same time he had the Guard called to federal active duty, taking them away from the governor, and ordered them home.

Kennedy, in 1963, during the argument with Gov Wallace over the court ordered desegregation of the University of Alabama, preemptively ordered the Secretary of Defense to call the Alabama guard to active federal service. This prevented their use by Wallace.

Some states maintain a state defense force, militia, which is strictly under the control of the state. There are currently 21 state's with active defense forces, including some with army, navy and/or air elements. Other states have authorized but non established forces, or inactive forces. North Dakota is one of the states that has created no state authorization for a state defense force.

Nice that "the governor " can just use the "military" under the Title 37 -1 in the state, on some "trump" up scheme, while the "oil" company can bring in attack dogs and use that under the auspice of imminent domain and attack the Indigenous brothers and sisters, mothers and fathers, aunts, uncles, and non-natives.
