DOJ appeals Judge Cannon's ruling in Trump's theft of classified documents case - Glenn Kirschner



The Department of Justice filed its notice of appeal, signaling it will challenge the ruling of Judge Aileen Cannon ordering a special master to review the evidence, including the classified and national security documents, the FBI seized from Mar-a-Lago. To the surprise of many, Judge Cannon also ordered that the DOJ/FBI halt its criminal investigation of the classified documents Trump stole from the federal government and unlawfully concealed at his Florida home. However, Judge Cannon also indicated in her order that the intelligence community risk assessment - trying to determine how and to what extent Trump's conduct my have endangered our national security - can continue.

In the DOJ's new court filing, federal prosecutors explain to the judge how it is impossible for the intelligence community to conduct a risk/threat assessment without the FBI investigating/developing the facts the IC community needs to conduct a risk assessment.
