By the time the doj gets to the point of getting a search warrant to grab your phone, they already have enough evidence to indict you.

They would have had to lay out the evidence to a judge showing a crime was committed and they need the phone as evidence.

Lets also keep in mind how incredibly stupid this guy appears to be. It's really amazing he was able to grift his way to wealth.

2. One of the goals is to prove Obstruction of Justice. Get the original data and then get the phone.

If the original data has disappeared after a subpoena then the target is probably obstructing justice. (Obviously, IANAL)
