The United States Supreme Court has held that officers may not extend or prolong traffic stops without reasonable, articulable suspicion to conduct further criminal investigation. (Rodriguez v. United States, 575 U.S. 348 (2015): A stop may “last no longer than is necessary to effectuate the initial purpose of the stop.

They are arguing that this is consensual because they were told they can leave. But they have been denied permission to search, and they had no PC or RAS. This is a gross 4th Amendment violation two ways: Detaining the driver, and searching the car.
