Judge won’t delay sentencing of real estate developer on fraud, other charges

A federal judge has refused to postpone the Aug. 31 sentencing of a Delaware developer on fraud and environmental charges.

Seventy-five-year-old Joseph L. Capano pleaded guilty in March to bank fraud and knowingly violating the federal Clean Water Act. He faces up to 33 years in prison and fines of $1.25 million.

Capano admitted using loan proceeds earmarked for a housing project in New Castle for personal purchases. He also admitted ordering unpermitted construction activity on protected wetlands.

As part of the plea, Capano was required to provide prosecutors with complete and accurate financial records, but he has failed to do so.
