Missouri Farm Bureau, MFA, sue OSHA over vaccine mandate
NEW BLOOMFIELD — Three large Missouri employers filed a lawsuit in federal court Tuesday challenging the Occupational Safety and Health Administration's vaccine mandate for companies with more than 100 employees.
Missouri Farm Bureau, MFA Oil, and Doyle Equipment Manufacturing claim in the suit that OSHA exceeded its statutory authority in implementing the Emergency Temporary Standard (ETS) requiring all employees of those companies to either provide proof of vaccination or be subject to regular COVID-19 testing. They say the rule will disrupt workforces and further stress the supply chain.
Twenty-six states, including Missouri, have filed lawsuits in six federal circuit courts objecting to the mandate, according to the New York law firm Jackson Lewis.
The issue is not whether governments have the right to impose vaccine mandates. That issue has been settled since 1905 when the Supreme Court ruled in Jacobson vs. Massachusetts that state governments can mandate vaccine.
