Central Hudson takes FERC to court on power cost

The dispute over a federal plan to raise power prices in southeastern New York has gone into federal court.

Central Hudson Gas & Electric Corp. launched a filing today, Monday, in the U.S. Court of Appeals seeking to halt actions under the Federal Energy Regulatory Commission's plan and to compel FERC to act on a petition calling for a moderation or elimination of the plan.

Higher power supply prices are both the result and the aim of FERC's plan, called a "new capacity zone." This is supposed to make the mid-Hudson and areas to the south more atttractive for private enterprise to build more power plants in the area, which power agencies say is short of generation.
