Eugene lawyer suing state's top judge for allegedly going soft on slowpoke judges
The Oregon Supreme Court’s chief justice is being sued by a longtime Eugene lawyer who asserts that the jurist is committing a crime by ignoring a 106-year-old law that ties state judges’ paychecks to their productivity.
Attorney James Palmer alleges in the suit that Chief Justice Thomas Balmer is refusing to enforce Oregon Revised Statute 1.050, which states that a trial judge’s pay is to be suspended if he or she leaves any pending motion undecided for more than three months.
By failing to require compliance with the law, Balmer is committing the crime of second-degree official misconduct, the suit asserts.
Suing the chief justice — in his own court — for allegedly failing to enforce state law doesn’t happen too often in Oregon.
