Art. 42.014. FINDING THAT OFFENSE WAS COMMITTED BECAUSE OF BIAS OR PREJUDICE. (a) In the trial of an offense under Title 5, Penal Code, or Section 28.02, 28.03, or 28.08, Penal Code, the judge shall make an affirmative finding of fact and enter the affirmative finding in the judgment of the case if at the guilt or innocence phase of the trial, the judge or the jury, whichever is the trier of fact, determines beyond a reasonable doubt that the defendant intentionally selected the person against whom the offense was committed, or intentionally selected the person's property that was damaged or affected as a result of the offense, because of the defendant's bias or prejudice against a group identified by race, color, disability, religion, national origin or ancestry, age, gender, or sexual preference or by status as a peace officer or judge.

(b) The sentencing judge may, as a condition of punishment, require attendance in an educational program to further tolerance and acceptance of others.

Shawn Vaughn, Texarkana’s Public Information Officer told us today, “The reason why the men weren’t charged with a hate crime is because it didn’t fit the criteria. They spray painted these offensive words and pictures indiscriminately, not knowing the identities or races of the home and car owners.

While these two idiots didn’t know the races of their victims, unfortunately some of the car and homeowners were people of color.

Officer Vaughn assured us that if these acts of vandalism were targeted towards anyone other than a random act, Texarkana PD wouldn’t have hesitated to charge the men with hate crimes.

Could their actions receive harsher penalties under hate crime statutes?

The adult needs to spend some quality time locked up. At least long enough to have time to contemplate his sins without the interference of the pressures of day to day living. He should not be able to buy his way out of his dirty deed by just paying damages. If I were the judge, I would give him a lesson that he could remember for a long time.

The kids parents need to fork over the money, the kid needs a lot of community service and some professional counseling. I would also make him scrub the paint off of the houses.....

But, who knows, maybe they will be cultural heroes in their community in Texarkana.

However, if I posted every mishap about local idiots, then I would never get a break. These two idiots are facing felony charges now so it is going to cost them dearly for attorneys, fines, and restitution. If they can somehow manage the financial obligations, then they might be able to stay on probation with a lot of community service.

An activist friend of mine in the area said they were pissed because local media wasn't covering it. I'm shocked at the things I hear from that neck of the woods from time to time. Did you know there were three separate cars that drove into Black Lives Matter protests last year in Paris? I just heard that one yesterday.
