Lawsuit filed against 4 Virginia Beach SWAT officers who fatally shot woman at 7-Eleven
VIRGINIA BEACH -- A judge ruled Tuesday that a lawsuit filed against four Virginia Beach police officers who killed a woman during a shootout with a passenger in her car can proceed to trial.
The wrongful death lawsuit was filed in March by the family of India Kager, a Maryland woman and mother of two who was fatally shot Sept. 5, 2015, outside a 7-Eleven on Lynnhaven Parkway. Kagers mother, Gina Best, and Kagers estranged husband, Shaun Lowrance, are seeking $30 million in damages. Lowrance is the father of Kagers oldest son.
Kager had just driven into the convenience store parking lot when the officers rushed up to her car to arrest Angelo Perry. Police said Perry shot first and the officers returned fire, killing Perry and Kager. The couples 4-month-old son, who was in an infant seat in the back, was not harmed.
Deputy City Attorney Christopher Boynton argued in court filings that the case should be dismissed because the officers actions that night were justified.
