ACLU sues state, Virginia Beach officials for keeping man in jail months longer than sentence

A former convict is suing the Virginia Beach jail and the state Department of Corrections, claiming they violated his constitutional rights and Virginia laws when he was jailed for 77 days longer than his sentence required.

The suit, filed Monday by the American Civil Liberties Union of Virginia on behalf of John Louis Freeman Sr., says Freeman did not receive full credit for jail time he served after he was arrested in Massachusetts for crimes in Virginia Beach and Norfolk, despite two court orders for the Virginia Department of Corrections and the Virginia Beach Correctional Center to recognize the time.

Freeman is suing the Beach jail, Virginia Beach Sheriff Ken Stolle and the state corrections department and its director, Harold Clarke.

Freeman spent 515 days in a Massachusetts jail between 2011 and 2013 and an additional 14 days in 2014 as he awaited extradition to Virginia.
