An Israeli doctor was acquitted of libeling the father of Muhammad al-Dura, the boy whose death during the second intifada galvanized the Palestinian uprising.
The French Supreme Court acquitted Dr. Yehuda David on Wednesday of breaking doctor-patient confidentiality.
David in an interview with a French-Jewish publication following the 2000 incident had said an injury that Jamal al-Dura claimed he had sustained while reportedly being in the crossfire of Palestinian gunmen and Israeli soldiers was actually the result of an earlier attack by fellow Palestinians who accused him of being a collaborator. David had operated on al-Dura at a hospital in Tel Aviv.
Al-Dura sued on the basis of violating the laws of doctor-patient confidentiality.
A lower court had ordered David to pay al-Dura about $17,000.
The shooting of 12-year-old Muhammad al-Dura was captured on film by a Palestinian cameraman for France 2. Israel initially took responsibility, but a subsequent investigation by the Israeli military found that the bullets likely came from the Palestinian gunmen.
Philippe Karsenty, a French media commentator, was later sued for libel by France 2 for suggesting that the incident was staged by the Palestinians. He lost but a French appeals court overturned the decision.

This goes to show how an irresponsible anti-Israel western media is largely to blame for the 2nd Intifada, the thousands of lives lost as a result, and the destruction of the peace process.

Many orgs were better at making these claims than they were in recanting them once the truth came out.

(167 posts)The actions of France2 amount to malfeasance. The myth of Al dura that they created resulted in violence and death. If Mitt Romney is right, and corporations are people, than France2 should be tried for manslaughter.

(30,109 posts)...which goes to show they're just as committed now to disinformation on Israel as they were over a decade ago. To say the least, it's impossible to know the situation on I/P relying almost primarily on the western press and human rights NGO's.
The western media and NGO's were as indignant as they had ever been 10 years ago during the al-Dura flare up. Now of course they're silent. And they show no outrage whatsoever to the vile genocidal hatred and incitement found throughout Palestinian media. Indeed, they do their best to cover it up and censor it out of the western press.
And the reaction among so-called progressives and many liberals they use as their tools? They don't get it, they don't care, and they would like very much if we'd just shut the fuck up.

(30,109 posts)Following yesterdays inconclusive verdict in the libel appeal of France 2 and Charles Enderlin against Philippe Karsenty, we have received the following reaction from Karsenty:
Contrary to the recommendation of the advocate general, advising the court to reject the appeal filed by Charles Enderlin and France 2, the Court of Cassation [Frances highest court] nullified the acquittal pronounced by the Appellate Court of Paris on May 21, 2008.
The nullification, which is disciplinary and based on a legal technicality, does not prejudge the outcome: the Court of Cassation deems that the Appellate Court of Paris could not order France 2 to show the raw footage containing images that were not broadcast by France 2. However, the legal criteria of my good faith quality of the investigation, absence of personal animosity, legitimacy of aim and purpose, prudent and measured expression were not challenged.
Charles Enderlin, France 2, and I will find ourselves in court again at an undetermined date to plead our cases in the al-Dura affair. The case will be heard again in the Appellate Court of Paris, by a different panel of judges convened to reexamine the facts.
I serenely anticipate the hearing that will allow me to present once more to the court and concerned media the demonstration that France 2 broadcast a staged scene as news on September 30, 2000.
In more than eleven years of controversy, we have brought dozens of pieces of evidence and scientific expertise showing that the scene was staged, whereas France 2, Charles Enderlin, and their cameraman have never been able to prove the veracity of their reportage. Further, it has been revealed through a succession of court cases that France 2, Charles Enderlin, his cameraman, and the father of young Mohammed have lied on several occasions to cover their media fraud.
I have presented the al-Dura affair in many journalism schools and festivals, in prestigious European and American universities, before the Senate and the House of Lords; no one has ever succeeded in refuting the evidence of a staged scene.
I call upon open-minded people to pursue the search for the truth. This is a combat for the honor of the journalistic profession, for justice, for democracy and against disinformation; a combat against the murderous anti-Semitism conveyed by this reportage. I ask those who in good faith believed the narration imposed by this reportage to simply examine the facts without prejudgment.
It is the uncompromising establishment of the truth that will contribute to the sorely needed peace, tolerance, and friendship among people and nations.
