Except for gay conservative groups, the decision is seen as a victory for the president and LGBT Americans who disproportionately face barriers to accessing health care, advocates say.
The U.S. Supreme Court upheld the central provision of health care reform legislation on Thursday, keeping intact the law that improves access for LGBT Americans who disproportionately lack affordable care.
In a 5-4 decision issued on the final day of the courts term, the justices voted to uphold the individual mandate, and thus preserve the entire law, known as the Affordable Care Act, under Congresss authority to tax.
The high court rejected the argument, advanced by the Obama administration, that the individual mandate was constitutional under the commerce clause of the Constitution, reported the Washington Post. But Chief Justice John G. Roberts Jr. joined the courts four liberal justices Ruth Bader Ginsburg, Sonia Sotomayor, Stephen G. Breyer and Elena Kagan in voting to uphold the mandate, ruling that a penalty for refusing to buy health insurance amounts to a tax.

(220 posts)in states that do not allow us to marry? The calculators that i have seen refer to households, but make no consideration as to being related or not. So in my case, i live in PA which is very anti-gay rights and my partner works but I do not because of a medical condition which the state refuses to cover. So, as a result it would seem that my partner will have to cover the mandate part of the health care law, even though we are not recognized as a family in our state. I don't know if i am misunderstanding the law concerning the mandate or not, however it seems to be a bit unfair to expect accordance with this law while discriminated against by both the state and federal governments. Hopefully, someone could help me clear up this confusion.
