Copyright and Marriage Equality Act Reintroduced
Yesterday, on the first day of the 114th Congress, U.S. Senator Leahy (D-VT) reintroduced the Copyright and Marriage Equality Act, a bill that would fix wording in the Copyright Act that currently prevents some same-sex couples from receiving inheritance rights.
After the U.S. Supreme Courts struck of part of the Defense of Marriage Act in the Windsor decision in 2013, the Obama Administration began to provide most federal spousal benefits to legally married same-sex couples, regardless of where they live. However, because of restrictions in the law, some agencies including the Copyright Office, the Social Security Administration, and the Department of Veterans Affairs do not recognize same-sex couples living in states without marriage equality. This legislation corrects the problem so that the federal government can recognize all legally married same-sex couples.
