Federal judge again rules key part of new D.C. gun law unconstitutional

Ten months after striking down the District’s long-standing ban on carrying firearms in public as unconstitutional, a federal judge Monday ordered the city to halt enforcing a key provision of the new gun-permitting system it adapted in response.

As passed by the D.C. Council, the District’s new carry legislation remains among the strictest in the nation, requiring applicants to state good reason to carry a weapon in order to obtain a permit from police, matching laws in Maryland, New Jersey and New York.

However, in a 23-page opinion, U.S. District Judge Frederick J. Scullin Jr. ruled that condition — known as the “good reason/proper reason” requirement — still “impinges on Plaintiffs’ Second Amendment right to bear arms,” because it fails to target dangerous people or specifically how or where individuals carry weapons.

“The issue here is not whether the .?.?. requirement is a reasonable or wise policy choice. Rather, the issue is whether this requirement, no matter how well intended, violates the Second Amendment,” Scullin wrote.


I see the DC council and DC police lose again on gun control.

....STAY DENIED.....

They "WILL" be issuing permits immediately...but only to those parties in the lawsuit...

LOL, lets see how THAT works out for them. I sense some more lawsuits being filed...

Chicago tried the same thing and the judge told them they "were trying to be too cute by half".

That was a trial transcript worth reading.

Just like most of our own gun control fans, rely on someone else to do all the heavy lifting and pay the bills.

"Stand up to the (fill in the blank)" NRA, GOA, SAF etc. ... as long as you don't have to reach for your wallet, or have to get off the couch and go to a town hall or hearing on anything.

In Chicago it's become a tradition for the ISRA and SAF to publish pictures of Rahm's signed checks to them for the public to see how much he's pissing away on fighting the 2nd amendment.

Our cops and firemen have recognized that every million or so going to gun lawyers is money not going into their broke pension funds.

And they aren't pissed at the NRA, SAF, ISRA about it.
