Washington (CNN)- An Ohio county judge ruled Friday that 17-year-olds will be allowed to vote in Tuesday's primaries, a victory for Bernie Sanders' campaign.
Franklin County Judge Richard Frye determined that Ohio Secretary of State Jon Husted, a Republican, erred when he ordered that Ohioans who are currently 17 but will be 18 on election day in November not be allowed to vote in the presidential primaries.
Husted's office said he would appeal the ruling, which applies to all election boards in the state and orders them to accommodate 17-year-olds Tuesday.

(1,024 posts)I have seen no evidence indicating that Clinton wanted 17-year-olds to have the right to vote.
This court case only came about because the Sanders campaign filed a suit against Ohio's secretary of state.

This ruling was in a state court lawsuit filed by Fair Vote http://www.fairvote.org/17_year_old_ohians_can_vote_in_presidential_primary
FairVote's legal team noted that an intepretation of law was at issue:
"Presidential primaries technically elect delegates on behalf of candidates, who will then go on to vote for their assigned candidates at the party conventions this summer. Due to this technicality, the Secretary of States office says that 17-year-olds are forbidden from voting in the presidential primary. No other state with 17-year-old primary voting appears to follow this interpretation of law."
Studies have shown that 17-year-old voters have a higher turnout than 18-year-old voters. Also, allowing for civic participation at a young age can foster a lifetime of engagement.
Here is the ruling in that case which is in state court and not federal court http://electionlawblog.org/wp-content/uploads/16-2346-Final-Opinion.pdf The Fair Vote people won this victory.

Obviously, regardless of CNN's mistake, this is good news.
Voter suppression is disgraceful, and the less of it we have, the better we are.

(145,722 posts)Election law is my hobby and I looked at both sets of pleadings. The Fair Vote people won a great victory. Their lawsuit was filed a while back and so there was a chance for the court to rule. I saw on Twitter that Husted will not appeal https://twitter.com/chrisgeidner/status/708446868708204545/photo/1 From Husted
