Attention NY Voters Wrongfully Purged From the Rolls: A Judge Has Ruled in Your Favor!

If you have not yet voted, then please do so. Ask for an affidavit and put this docket number on it: "Docket CV-16-1892"

New York Primary Update: Voters Wrongly Purged From Democratic Party Rolls May Still Be Able To Vote Judge Declares


The lawsuit was brought by Election Justice USA

The group had filed a lawsuit on Monday seeking to open the state’s primary to voters whose party affiliations had changed without their knowledge. There were numerous reports of voters who met the state’s October deadline to register with a party but found out that either their affiliation was never updated or somehow switched to unaffiliated.


This is exactly what happened in Az also, now under investigation by the DOJ

“This is our attempt to provide a means of recourse for those thousands of New York voters who find themselves in this very frustrating position, and to raise awareness about the need for a new level of accountability in the electoral process,” said Shyla Nelson, a spokesperson for Election Justice USA, in an interview with Think Progress.

The lawsuit had sought to make Tuesday’s primary open to all voters, allowing any registered voter to cast a ballot for either party, but the lawsuit itself was not heard until 9 a.m., the same time voting began for downstate residents. It was then moved to 2 p.m., and the resolution did not come until close to 3 p.m.

After Tuesday’s update, Election Justice urged voters who believe they rightly belong in the Democratic Party to demand provisional ballots.

“A suggestion by one of our visitors – ‘Reference Docket # CV-16-1892 on your provisional ballot & don’t let them turn you away; you have a constitutional right if you’re a Democrat who was purged without notice.'”


A new hearing has been scheduled by the judge.

But meantime anyone who thought they could not vote due to having their registrations altered STILL HAVE TIME to do so. Polls are open until 9.00 PM.

19. Sounds like a good judge! Widespread sloppiness,

late poll openings, and various irregularities like these allegations are blowing up in their electoral system's face. With a judge committed to making sure all citizens who are entitled to vote do vote, these complaints will be investigated and eligibility determined.

Any who had genuinely registered as Democrat and Republican long ago now, would of course now be Democrats and Republicans blocked from voting in their party's primary, not independents wanting to vote in parties they didn't belong to. So I imagine both parties are also more than a little unhappy.

3. this is super news...but why isn't this being covered non-stop on local news?

I am in NY and have been watching a local Plattsburgh station since about 5 pm and not a peep about this.

But, this doesn't apply to allowing Independents to vote does it.?

Just for the voters whose reg was changed without their knowledge?

7. That's why I posted it here, it is not being reported on the news. We knew about the case

but had to go to Independent media to find out what was going on. It is the DUTY of the Media to inform voters who were wrongfully purged from the voting rolls that they still have time to vote.

Shame on all of them. They care nothing for this country or/and its people.

On the good side, I am GLAD this happened, for over a decade Americans have been TRYING to draw attention to the gross election fraud that has pervaded our system for so long.

Maybe NOW we can start the process of ending the many ways in which voters are being cheated out of their most basic right.

13. Yes, I'm sending to everyone, place where it may be in time for voters who thought they could not

vote to do so. I'm sure many were denied but hopefully when the next hearing takes place, the Dem Party officials in charge, who have been ordered to attend the hearing btw, will be ordered to find those voters, and provide them with the opportunity to vote. This has already happened in another state.

16. Apparently some upstate voters are being denied affidavit ballots

State Attorney General Eric Schneiderman announced he has a hotline staffed by attorneys and staff in his Civil Rights Bureau for Tuesday's primary. The number is 800-771-7755.

The statewide hotline debuted in November 2012. Schneiderman said his office fielded hundreds of complaints from voters and worked with election officials to quickly address issues.

Schneiderman's spokesman said the office also received complaints about poll workers allegedly denying voters affidavit ballots when requested. He said this was primarily a problem in upstate counties.

17. Wow, I didn't know that suffragette and I'm upstate. Good for Schneiderman who is a pretty good

AG. I will put the number in the OP. Thank you for supplying it. What a shame, we had no problem in the little town where we live, a small rural town. The poll watchers all seemed to be very helpful. ANYONE engaging in this kind of election fraud should be arrested and prosecuted. I hope people are taking down all information.

Or to anyone for that matter? They were instructions as to the remedy currently available to them. The lawsuit asked for an open primary.

The law already allows for disputed eligibility remedies at the polls themselves. So 3.2 million voters never had their voting rights taken from them, no?

34. People's registrations were ALTERED. So no, the remedy for that CRIME is hopefully going to come

later when those responsible for the elections, see AZ if you haven't been keeping up, have been ordered by the judge to appear.

This is a crime as it should be and the remedy for a crime is to find out WHO committed the crime and then prosecute that or those persons.

Meanwhile people were told they could not vote. Many will not have received the necessary information to vote rendering this whole election corrupted. Not the only thing that was done in NY to suppress the vote.

The State AG is now involved due to so many reports of other ways in which people were denied their rights to vote.

Polling places switched yesterday, machines not working. Just like Az, it's almost as if there is a pattern in delegate rich states.

Az may now have to redo their primary. And NY may end up doing the same thing.

Voters are NEVER to blame for the actions of those who work hard to make it DIFFICULT to vote, unless you live in some kind of third world country

39. There will be another hearing, but no, the word didn't get out to all those who were denied their

right to vote. Mayor De Blasio made a public announcement last night to tell the 126,000 Brooklyn voters who were scrubbed from the rolls to 'go back and vote with provisional ballots' but it was too late. This will have to be dealt with. It's happened in other states and courts have ruled that those voters must be allowed to vote.

NY's results should be halted until this is resolved, no delegates assigned until every person votes. As it happens Hillary didn't win that many more delegates than Bernie, just 29 so she has failed to reduce her huge losses over the past string of defeats she has suffered. But that's beside the point. It's shameful and unacceptable that so many were denied their right to vote.

De Blasio is calling for reform, that's fine for the future, but when hundreds of thousands of voters were prevented from voting, that must be resolved NOW.
