Mental health gun bill suffers surprising defeat in DELAWARE Senate



In a surprise move, state senators overwhelmingly struck down a proposal Thursday preventing the dangerously mentally ill from owning guns.

Several Democrats joined Republicans in the 6-13 vote, with freshman Senators Nicole Poore (D-12th District) and Bryan Townsend (D-Newark) abstaining.

The bill required local police, the attorney general’s office and a state judge to agree on whether a person is a threat to themselves or others before temporarily stripping them of their guns in a civil procedure.

Opponents say they worried it didn’t provide enough due process for people accused of being mentally ill.

Attorney General Beau Biden says he thought he had enough votes to pass the measure.

“Something happened in the last 24 hours. I don’t know if there were members of the General Assembly who feared lobbying efforts from I don’t know who, but something changed in the last 24 hours. I don’t know what it was,” he said. Biden says he isn’t giving up on the issue.
