I was outside yesterday and a young man came by who was campaigning for Warren. People at her events really are drawn in by her. Besides her endless ideas and "plans", she is genuinely authentic. I think people are so tired of scripted, insincere politicians.

16. Wealth tax would seem to be an unconstitutiinal direct tax.

 

The 16th Amendment allows a tax on "incomes, from whatever source derived." Presumably a wealthy person has paid whatever income tax was owed when they made the money they have. And if they haven't, go after them for that.. A wealth tax is a separate thing. I'm not necessarily against it. But I am thinking pragmatically. The ACA was barely declared constitutional. Is a federal wealth tax constitutional? And if we need to amend the Constitution to allow for it, let's talk about that.

30. I am not for a wealth tax because like you, I think that is targeting peopke

 

simply for who they are. BUT, I believe in a fairer income tax and taxing carried interest investments at a higher tax rate. If we had a true progressive income tax where higher incomes paid higher rates, with deductions ONLY for activities that promote economic growth such as new plant and equipment, an enormous of money would be raised to rebuild infrastructure and pay down debt. Taxing profits on carried interest investments at a higher rate would generate large revenue for healthcare reform and properly funding public schools.

I think the wealth tax proposal is trying to right the wrongs of the past, that allowed wealth to accumulate as it did. However, your solution is more practical and will hold up to court challenges.

The U.S. Constitution applies to them, too. If something is unconstitutional, the states can't do it either. If state and local property taxes violated the U.S. Constitution, states and localities wouldn't be able to levy them.

51. You are oversimplifying the situation.

 

Some provisions in the Constitution apply only to the federal government, others only to the states, still others to both.

The restraints in Article 1 Section 9 apply to the federal Congress, not the states. The 4th clause of that section reads:

No Capitation, or other direct, Tax shall be laid, unless in Proportion to the Census or enumeration herein before directed to be taken.


The 16th Amendment, ratified in 1913, modified that restriction:
The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.


Prior to this amendment, income taxes were enacted by Congress but repeatedly struck down by the Supreme Court.

Other than a tax on "incomes", it is easy to argue that the restriction still applies to any other direct tax. If I wanted to creatively defend a wealth tax, I suppose I would argue that it is a tax on incomes earned in the past. But that's a pretty weak argument, since it wouldnt really be based on that. A formerly rich person who blew their fortune already, would not owe the wealth tax, while someone who had lived a bit more frugally even if they had earned less income than the profligate spender, could end up owing it.

is proposing to pay for so much of what she wants to do from a tax which is going to be challenged in the courts from the moment the legislation is passed.

I love Warren. I worry that, like Clinton, she has already been defined over years by the GOP and that could hurt her in some swing states. I wonder how competitive she would be in NC, GA, OH and FL as examples. She probably is my fav politically but I do want to win and outside of Biden, I think people are yearning for new blood. Anyone on stage will win the states Clinton won. We need a few more. I may be wrong but just my gut.. Any of these guys/gals are 100% better than Trump

"Electability" is a factor, but I'm wary of that being too much of a driving force because too often it's based on a fear of what other people are going to do. People become electable when enough people vote for them. and I think if enough people support the candidate they really feel most strongly about for the right reasons, candidate becomes electable.

So, if Warren's your person, go for it!

lose! And it's because we had 80% of Dems on board in December and every month of no action has dwindled that down to the 50%'s. We are not standing up for what is right! So it doesn't matter who we put up...if you can't stand up to the basic essence of our values no matter what the consequences are..you will ultimately lose. Sad, very sad as that is.

33. I thing that she will spend an enormous amount of time on the campaign trail.

 

Hillary took days off at a time and only did one or two events on some days and did not go to medium sized and small cities and every key state. All of that played into the narrative that Trump and the right painted of her being ill and a risk if elected. Throw in the Russians (who helped with the ill lie, along with other help for Trump) and we get to where we are today.

Elizabeth Warren shows boundless energy and she is already going to talk to voters in out of the way places. I believe that will present a vast contrast to Trump, forcing him to campaign until his sucky health overcomes him.

52. Don't care for her "Economic Patriotism" (essentially the same "America First" crud we have now).

 

Her bashing of Obama on trade also helped put us where we are now.

I'd also like to see verification of her claim that the wealth tax (not a bad idea, otherwise) will bring in enough to fund healthcare, college debt forgiveness, "free" college, childcare, etc.
