Gov. Jim Justice has appointed a new person to replace a former state delegate who resigned earlier in January following federal charges for participating in an insurrection that turned violent at the U.S. Capitol.
Justices appointment is met by a 17-page writ of mandamus from a local Republican leader, arguing that the governor violated state laws with his final pick for office.
Joshua Booth, a Republican in Kenova, Wayne County, will join 99 others in the House of Delegates for the 2021 legislative session on Feb. 10.
Booth is vice president of Highway Safety, Inc., in Huntington, a traffic safety and construction firm, according to a press release from Justices office. He graduated from the old Ceredo-Kenova high school in 1998 and later graduated from Marshall University with a degree in business administration

Sentencing Delayed For Fired VA Nursing Assistant Who Killed 7
Sentencing has been delayed for a former staffer at a veterans hospital in West Virginia who pleaded guilty to intentionally killing seven patients with fatal doses of insulin.
A federal judge on Friday granted a motion by attorneys for Reta Mays to push back her sentencing. It now will be held May 11-12. It had been scheduled for Feb. 18-19.
Prosecutors had opposed the request as unreasonable.
Mays, a former nursing assistant at the Louis A. Johnson VA Medical Center in Clarksburg, was charged with seven counts of second-degree murder and one count of assault with the intent to commit murder of an eighth person. She admitted in July to purposely killing the veterans, injecting them with unprescribed insulin while she worked overnight shifts at the hospital in northern West Virginia between 2017 and 2018.

Some puppy buyers duped by fake Nebraska kennels
OMAHA, Neb. (AP) Some unsuspecting puppy buyers are being scammed by people using Nebraska addresses on fake kennel websites.
Jim Hegarty, president of the Better Business Bureau's Omaha office said one person from Texas reported losing more than $5,000 after paying a deposit for an Akita puppy from a fake Nebraska kennel.
Hegarty said his organization recommends meeting a puppy in person before paying, and he said buyers should watch out for deal that appear to be too good to be true if a dog is selling for significantly less than that breed normally would.

Maine company successfully launches prototype rocket
BRUNSWICK, Maine (AP) A Maine company thats developing a rocket to propel small satellites into space passed its first major test.
Brunswick-based bluShift Aerospace launched a 20-foot prototype rocket on Sunday.
It hit an altitude of a little more than 4,000 feet in a run designed to test the rockets propulsion and control systems.
bluShift held the test at the site of the former Loring Air Force Base. The company is one of dozens racing to find affordable ways to launch so-called nano satellites.
Some of the satellites can be as small as 10 centimeters by 10 centimeters.

Enraged West Virginia educators speak out after vaccine distribution changes
CLARKSBURG, W.Va. (WV News) After an announcement from the West Virginia Department of Education regarding vaccine distribution to school employees Thursday evening, educators and service personnel are taking to social media to voice their anger with the announced changes.
According to the WVDE announcement, as of the close of business Friday, all school employees, age 50 and above, who had requested a vaccine by the issued deadline had received it.
The states COVID-19 Vaccine Allocation Plan categorizes school employees as essential workers and says they are prioritized as such. Now teachers are being asked to register at vaccinate.wv.gov using the same Everbridge registration process as health-care workers, many of whom have yet to be vaccinated.
School employees who are scheduled for a second vaccine will receive them at the school where they received their first dose, the WVDE states. All others will be directed as needed upon registering (with the state).

OxyContin-maker Purdue Pharma wants say in release of records in W.Va. court
OxyContin-maker Purdue Pharma is asking a West Virginia judge to keep thousands of court records secret until the companys lawyers have a chance to review the documents and say which ones should remain hidden from the public.
The court documents were filed two decades ago as part of a class-action lawsuit against Purdue. The entire court file remains sealed and the records are being kept in storage in Putnam County.
In a filing this week, Purdue told Putnam County Circuit Judge Philip Stowers that some of the records including videos and tape recordings may be commercially sensitive. The company filed for bankruptcy in 2019 and recently pleaded guilty to federal charges over its role in sparking the opioid epidemic.
Last month, HBO, The Washington Post and a documentary film company filed a motion in Putnam County to unseal the Purdue Pharma records from the 2001 lawsuit that accused the drug manufacturer of failing to supervise the use of its highly-addictive painkiller OxyContin. The drug was being diverted to the black market, and West Virginians were overdosing and dying in record numbers. The case was settled for an undisclosed amount in 2007.
