The Legal Argument in Nicholas Sandmann’s Defamation Lawsuits Is Basically “MAGA”

Nicholas Sandmann, the high school student at the center of the viral Lincoln Memorial confrontation in January, wants to “punish” CNN and the Washington Post for attempting to “assassinate” his character. He wants to teach the Post “a lesson it will never forget” and halt CNN’s “biased agenda against President Trump” and his supporters. In the process, Sandmann wishes to collect more than a half-billion dollars from the two outlets. The media targeted him because he was a “white, Catholic student who was wearing a MAGA cap,” Sandmann believes. Only $525 million in damages will fully compensate him and deter these “bullies” from “again bullying other children.”

This argument, laid out in Sandmann’s two lawsuits against CNN (filed on Tuesday) and the Washington Post (filed in February), is one part legal theory, two parts political screed. Sandmann’s lawyer, famed libel attorney L. Lin Wood, knows that these suits are a long shot: The First Amendment protects the press’ right to report on a national controversy without a full grasp on the facts, and to provide commentary that ultimately proves inaccurate. Wood’s defamation lawsuits are designed to scare CNN and the Post, to chill their future criticisms of “individuals perceived to be supporters of the President.” His crusade is just another skirmish in President Donald Trump’s attack on “fake news.”

Like most mainstream media outlets, CNN and the Washington Post provided an incomplete and unduly harsh description of the January encounter between Sandmann and Nathan Phillips, a Native American activist. On the basis of a viral Twitter video, reporters at these companies alleged that Sandmann, a 16-year-old March for Life participant wearing a MAGA hat, attempted to “harass,” “accost,” or “mock” Phillips. Commentators on CNN condemned Sandmann as racist and aggressive toward Phillips. Articles in the Post alleged that he threatened and intimidated the activist. .......................................................................................................



There is still a slim but real possibility that Sandmann will persuade the courts that the Constitution does not shield CNN and the Post from his lawsuit. He may then convince a jury to slap both outlets with crippling damages. If so, expect a court to substantially lower those damages, since Sandmann cannot possibly prove that $525 million is an appropriate award. If the student wins, Trump will declare victory, and Sandmann’s fiercest defenders will feel vindicated. The press, meanwhile, may hesitate before jumping into the next public debate spurred by a seemingly outrageous video. Whether you think that’s a threat to free expression or a necessary safeguard against bias will probably depend on how you feel about Nicholas Sandmann.

President Donald Trump on Friday insisted there should be no report from special counsel Robert Mueller's Russia probe, denouncing the investigation as "illegal."

"So, if there was knowingly & acknowledged to be 'zero' crime when the Special Counsel was appointed, and if the appointment was made based on the Fake Dossier (paid for by Crooked Hillary) and now disgraced Andrew McCabe (he & all stated no crime), then the Special Counsel...should never have been appointed and there should be no Mueller Report," the president tweeted Friday.

The House on Thursday passed a resolution 420-0 urging the Justice Department to make Mueller’s findings and full report public and available to Congress. Senate Republicans, however, blocked the bill.

The president on Friday also complained that the probe was only started as an excuse for Democrats losing the 2016 election....................................

What we know now


The shootings: At least 49 people were killed and 20 seriously injured, after mass shootings at two mosques in the New Zealand city of Christchurch.
The suspects: Police said four people have been taken into custody, and one of them has already been charged with murder. An account believed to belong to one of the attackers featured a link to an 87-page manifesto filled with anti-immigrant, anti-Muslim ideas.
How the country is responding: New Zealand Prime Minister Jacinda Ardern has described the attack as an "unprecedented act of violence" and called it "one of New Zealand's darkest days."





"Shame on the people who have promoted this kind of hate"


Speaking on CNN Talk, political commentator Ayesha Hazarika said that, as a Muslim, she is "sickened and frightened" by the attacks.

"We have a culture, a media and social media culture, that not only tolerates hatred to Muslims but celebrates it," she said. "Shame on the people who have promoted this kind of hate.

"I have friends who have contacted me saying they’re scared to go to mosques. Today is a dark day," said Hazarika.

The Trump Foundation reached a deal in December to fold and distribute about $1.7 million in remaining funds to other nonprofits in a court-supervised process. Each charity will get the same amount, and the attorney general’s office has the right to reject the ones it deems unfit.


That agreement, though, didn’t resolve the lawsuit, which says the foundation’s involvement in a Trump maneuver during the run-up to the Iowa caucuses in 2016 broke rules barring charities from getting involved in political campaigns.

Instead, he held a rally at the same time as the debate at which he called on people to donate to veterans charities. The foundation acted as a pass-through for people who heeded his call for donations.

James said the evidence of banned coordination between campaign officials and the foundation includes deposition testimony from Trump Organization executive Allen Weisselberg and emails he exchanged with former Trump campaign manager Corey Lewandowski.

Trump was also accused in the suit of directing that $100,000 in foundation money be used to settle legal claims over an 80-foot flagpole he had built at his Mar-a-Lago resort in Palm Beach, Florida, instead of paying the expense out of his own pocket.

NY attorney general: Evidence shows Trump misused charity for presidential campaign

New York Attorney General Letitia James (D) said in a filing Thursday that President Trump misused his charitable foundation to assist his 2016 campaign, The Associated Press reported.

James is suing the Trump Foundation for $2.8 million in restitution and seeking an order banning the president and his three eldest children from running any charities in the state for 10 years.

The lawsuit reportedly cites insider testimony and emails as part of its evidence.

The Trump Foundation shut down and distributed about $1.7 million in remaining funds to nonprofits in December in a court-supervised process.

On Thursday morning, Donald Trump sent out a pointed missive ahead of the Senate’s vote to block his emergency declaration: “A vote for today’s resolution by Republican Senators is a vote for Nancy Pelosi, Crime, and the Open Border Democrats!“

Soon after, White House aides began blasting the tweet to GOP senators by text message to remind them of how the president viewed the impending vote, according to senators and aides who received the messages.

The last-minute lobbying did little to quell a Republican rebellion that eventually arrived in eye-popping numbers: a full dozen GOP senators joining Democrats in voting to overturn Trump’s unilateral move to fund his border wall.

It didn’t have to be that way, Republicans say, especially if Trump had engaged more consistently with senators and made a relatively modest agreement to change the National Emergencies Act to rein in presidential power.

It was also a reminder that White House aides have long acknowledged the futility of speaking for or negotiating on the president’s behalf, a position they are now openly conveying to lawmakers: passing along his tweets rather than attempting to twist arms or hash out a compromise themselves. ........................................

Trump job approval slips 4 points in Gallup poll

President Trump’s approval rating dipped by 4 percentage points to start March, according to a new poll, dropping below 40 percent.

The Gallup poll released Thursday showed Trump with a 39 percent approval rating, down from 43 percent in the second half of February. Trump closed the month with an unsuccessful summit with North Korean leader Kim Jong Un and saw his former personal attorney Michael Cohen deliver explosive testimony before House lawmakers. March also opened with a less-than-stellar jobs report.

Trump's approval rating is buoyed in large part by Republicans, 90 percent of whom gave him positive marks in the Gallup poll. Thirty-three percent of independents approve of Trump, as do just 4 percent of Democrats, according to the poll.

The poll surveyed 1,039 people from March 1 to 10 and has a margin of error of 4 percentage points.

Trump makes last-ditch effort to stop Senate rebuke of emergency declaration

The repeated warnings, however, appeared to do little to stem the tide of GOP defections. Sens. Lamar Alexander (R-Tenn.) and Mitt Romney (R-Utah) both announced Thursday morning they would vote for the resolution, joining five other Republican senators who say they will as well.

If the Senate passes the resolution with strong Republican support, it would worsen the sting for Trump, who has made the border wall his signature issue and harangued members of his own party to support his effort to build it. The Democrat-controlled House has already approved the resolution, meaning Trump will be forced to use his veto powers for the first time.

Lawmakers in both parties believe Trump exceeded his authority when he invoked his emergency powers to obtain money for the wall after Congress refused to grant his request for billions of dollars in funding, which had triggered a 35-day government shutdown that dealt a political blow to the GOP.....................................................

Dick's CEO: Thoughts, prayers don't do anything




New York (CNN Business)Dick's Sporting Goods will stop selling guns and ammunition at 125 stores where firearm sales have struggled.
The company removed firearms and hunting accessories from 10 stores last fall as a test. The test went well and sales grew in those stores, Dick's said. So the company decided to pull guns, ammunition, and firearm accessories from an additional 125 stores where sales of the merchandise have underperformed.

"We look at this as a multi-year initiative," he said. "If it goes as well as expected, we would probably take another batch of stores next year," Stack said.
Last February, the company said it would stop selling assault-style weapons after the mass shooting at a Parkland, Florida, high school shooting. It also raised the minimum age for all gun sales to 21 and stopped selling high-capacity magazines that hold a large number of bullets for semi-automatic weapons.
Stack made the decisions after he learned that the teen charged with the Parkland shooting had bought a shotgun at a Dick's store. It didn't matter to him that the gun wasn't used in the attack..............................
