Apply that kind of fallacious thinking to the rest of our justice system?

Judge: Well, even though you have robbed several banks and accosted several people who have been hospitalized we want you to know that we are very concerned about that and we hope you won't continue your criminal ways. The court finds you virtually not guilty. You are free to go.

This reminds me of the old tale of The Frog and the Scorpion, also.
