(10,271 posts)Alito and Thomas for the dissent, sure, but Breyer should come down with the liberals on one (I would think) and that leaves Roberts. If he's feeling like the president is ignoring the court as a co-equal Branch, he will side with the liberals just to let the executive know he probably shouldn't be fucked with in his own house. I think this could be a nice test to see how much rope the executive will be extended by the Chief, but if they piss him off I think Roberts will have no problem jerking that leash a little.=)
I don't think it will be a tie, that's if the court even takes it to hear. A 3-0 decision is pretty airtight already...I would think the only reason to take it would be to closely examine an argument to overrurn, and that seems unlikley
