Every GD phone call, tweet, email etc. is tapped and recorded. FISA is a balm to calm the masses. The CIA doesn't listen to American phone calls? Horseshit. Besides, the British can listen to all of ours and vice versa. Doubt there's a problem sharing this info back and forth. The whole "wall of protection" supporting our right to privacy is a big fat myth.
This has been the case going back to Hoover and the FBI. We were told that under certain conditions the FBI had to stop listening and recording phone calls. They never did. They just knew that certain information wouldn't be allowed as evidence in court. But they had the information nonetheless.
So yeah, every phone in America is "tapped".

I think the way this works is the authorities can listen to the U.S. end of a conversation.

Actually the original leaker can still be prosecuted as just because something is now declassified

The leaker gets zero protection because someone else released or declassified it.
