that's what kind of a lawyer. Back when Spanky was just a sleazy real estate developer who got sued a lot, his lawyers would meet with him in pairs because they didn't trust what he might later claim they told him. Cohen was protecting himself. It might not have been ethical (although I'm not aware of any specific rules of professional conduct prohibiting it), but at least in NY, a one-party consent state, it was legal.
