13. From what I was told when I waned to sue a company, everybody involved has to be named

In the suit.

I had a situation where a crop duster was supposed to spray the soybeans on the farm next door but he kept his plane low over my property and did not turn off the spray as he passed over. This caused two problems - I reacted to the spray which was strong enough to kill insects inside my house; and also spooked my weanlings and a filly came in with an injured leg.

I threatened to sue the crop duster but my attorney told me that I would also have to sue the property owner, the manufacturer of the chemicals that were sprayed, and the leasee who was raising the soy beans on the place next door. Instead of doing that, I talked to the property owner. He was incensed - I had complained previously about the crop duster and he had told the leasee to make sure that the crop duster was more responsible about only covering the crops and not the entire neighborhood. Since the guy with the lease had not followed this agreement the property owner jerked his lease. He was allowed to collect the crop that was growing but was not allowed to have it sprayed again, and the lease ended once the crop was harvested.
