I agree with everything you said under normal circumstances. I'm just wondering if the law is designed to prevent the argument you just made by providing standing to those who didn't have it before.

In which case, I'd argue against the law on the grounds that those who didn't have standing before this law, shouldn't have it--ever--because of the 4th Amendment (which guarantees that the right to be "secure in their persons." )
