Instead, they should require a negative Covid test no more than 72 hours old to opt out.

Better yet, require that everyone mask up and exempt only those that either provide proof of vaccination or provide a negative Covid test no more than 72 hours old. That sidesteps all the MAGA/GOP nonsense and any possible legal action.
