That it was the SW M&P 380. The Bodyguard model comes with a 6 round magazine, +1 would be 7.

I realized however the Shield is also part of the M&P line (my bad) That does come with 8 round mags.

So it does still come back to details. Which specific model and what size magazine did it have. At this point I'm not fully rejecting the police version of events but noting there is a scenario which would make it very improbable
