brandishing, like stalking, has a specific definition, which means waving or pointing it at someone in a threatening manner.

Simply holding it in a photo isn't brandishing. Since there was no gun found, there is no evidence that it is a real gun. Just because someone decides to misuse the term doesn't make it so.
