About Me

I'm a lawyer primarily representing clients who are being sued. I am a retired Army Judge Advocate. Nothing I post here, including any comments about legal topics, should be construed as legal advice or creating an attorney-client relationship.

WPS!

That's Woo Pig Sooie for the uninitiated.

Arkansas advances to the CWS!

George Takei reaction to putting new family prison near site of Japanese-American internment camp.

Following is a link to a story in the on-line Arkansas Democrat-Gazette about George Takei's reaction to the administration considering placing one of the new family prisons near the site of the Rohwer, Arkansas internment camp where he was imprisoned as a child.

This is interesting because the Democrat-Gazette is a really conservative paper. Don't be deceived by the name.

History doesn't repeat itself but it rhymes.

Rachel just tried to read a story about "tender age" facilities for stolen children

and broke down crying.

All I can do - for now.

I have grown increasingly angry about the abuse of children on the southern border that it being done in my name. Then I started thinking about what Jesus said in Matthew 25 about not doing things for the least of these and it occurred to me that I wasn't doing anything except being angry.

I then wrote a letter to my Congressman and two Senators - all three of whom claim to be Christians - and told them we all risk the wrath of God if we don't do all we can to stop the abuse of children, that all I could do was write my elected representatives, but that they must do more if they want to continue to claim to be Christians.

Mind you, I'll vote against all three of these cretins at every opportunity but in the meanwhile, all I can do is write.

Please, DUers in red districts need to write their Representative and Senators. If they claim to be Christian, threaten eternal damnation.

Attack on the Arkansas Judicial Election.

For Arkansas DUers, the Judicial Crises Network - a right-wing conspiracy theory organization - is spending big money in Arkansas to buy a seat on the State Supreme Court. JCN has been running ads and sending mailers falsely attacking Justice Goodson. It has now turned its attention to Court of Appeals Judge Hixon who is also running. JCN is now clearly supporting David Sterling - the only candidate it has not attacked. (Who is clearly supported by the Arkansas GOP establishment.)

There is no evidence Mr. Sterling is "coordinating" with JCN but neither is he objecting to the infusion of dark money to his benefit.

I'll keep my own counsel about who I support but it is time for Arkansas voters to reject this blatant attempt to buy a Supreme Court seat.

150 square yards of sod just delivered.

I'll start laying sod at sunrise trying to beat the predicted heat as best I can. If I'm off the net for a couple of days, that means I'm down with my back.

If I'm laying sod on a Saturday, how early can I start drinking beer?

Arkansas Pro-Gun rally.

The local NBC affiliate did a very short bit on a pro-gun rally at the State Capital in Little Rock. The reporter read that "hundreds" turned out. From the video, I'd say maybe two or three hundred.

There were 3,500 to 4,000 at the Little Rock March for Our Lives. My report from that afternoon.

Remember, this is Arkansas I'm talking about. The gun nuts do not out number us.

The Day After Tomorrow?

Freezing temperatures are predicted in south Arkansas tonight - south Arkansas! On April 7!

I just brought in plants and started a fire in the fireplace. Tell me again how there is nothing to this climate change stuff.

Trump not a "target." Question for federal criminal attorneys.

I have a question, or maybe a theory, about the report that Mueller has told Trump's lawyers that he is not presently a "target."

Might that only mean that Mueller does not intend (at least for now) to seek an indictment? For instance, if Mueller has concluded a sitting President cannot (or ought not) be indicted but intends to report criminal activity in his report to Congress, would that explain this report?

Extension on edit: The guests on Chris Hayes were just advancing my theory, so maybe I'm not too far out there.

Military to Build "The Wall?"

Trump has suggested using money appropriated to the Department of Defense to fund his wall on the southern border.

I have to admit that federal procurement law is not - and never has been - my area. Nevertheless, my memory from back in my Army JAG days is that money can only be used if it is the "right color of money," that is money appropriated for the specific purpose. Money is specifically appropriated for research and development, operations and maintenance, etc. and can only be spent for that purpose. As a general rule, money cannot be moved from the account of one "color of money" and be spent for another. My understanding is that spending the wrong "color of money," in addition to violating federal statute also violates the "appropriations clause" of the Constitution.

It seems clear to me that the appropriations to DoD were not intended to build Trump's wall. Based on my very shallow understanding of the rules, this cannot be done.

I am curious if any one with a clearer understanding of federal procurement law has an opinion on whether Trump can find a lawful way to use DoD appropriations to build his wall.
