CNN: Federal judge upholds Harvard's admissions process in affirmative action case

A US district judge in Boston has upheld Harvard's admissions process following a challenge from a group of Asian American applicants who believe the school discriminated against them.

Judge Allison Burroughs ruled Tuesday that while Harvard's admissions process is "not perfect," she will not "dismantle a very fine admissions program that passes constitutional muster, solely because it could do better."

Burroughs found "Harvard's admission program passes constitutional muster in that it satisfies the dictates of strict scrutiny."

The ruling in the closely watched case is likely to be appealed and culminate in a national showdown over affirmative action at the US Supreme Court.

The challengers had argued at trial that as the "personal" rating system disfavors Asian Americans, it favors blacks and Hispanics, who generally have lower standardized test scores compared with Asian Americans.

Oh, FFS. NYT: Trump Pressed Australian Leader to Help Barr Investigate Mueller Inquiry's Origins

President Trump pushed the Australian prime minister during a recent telephone call to help Attorney General William P. Barr gather information for a Justice Department inquiry that Mr. Trump hopes will discredit the Mueller investigation, according to two American officials with knowledge of the call.

The White House restricted access to the call’s transcript to a small group of the president’s aides, one of the officials said, an unusual decision that is similar to the handling of a July call with the Ukrainian president that is at the heart of House Democrats’ impeachment inquiry into Mr. Trump. Like that call, the discussion with Prime Minister Scott Morrison of Australia shows the extent to which Mr. Trump sees the attorney general as a critical partner in his goal to show that the Mueller investigation had corrupt and partisan origins, and the extent that Mr. Trump sees the Justice Department inquiry as a potential way to gain leverage over America’s closest allies.

And like the call with the Ukrainian president, Volodymyr Zelensky, the discussion with Mr. Morrison shows the president using high-level diplomacy to advance his personal political interests.

President Trump initiated the discussion in recent weeks with Mr. Morrison explicitly for the purpose of requesting Australia’s help in the Justice Department review of the Russia investigation, according to the two people with knowledge of the discussion. Mr. Barr requested that Mr. Trump speak to Mr. Morrison, one of the people said. It came only weeks after Mr. Trump seemed to make military aid to Ukraine contingent on Mr. Zelensky doing him the “favor” of helping Mr. Barr with his work.

The Hill: McConnell says he won't block an impeachment trial

McConnell says he can’t completely prevent an impeachment trial

Senate Majority Leader Mitch McConnell reiterated on Monday that he is bound by Senate rules to take up articles of impeachment if they are presented by the House.

“Under the Senate rules, we’re required to take it up if the House does go down that path, and we’ll follow the Senate rules,” McConnell said. “It’s a Senate rule related to impeachment that would take 67 votes to change.”

That makes clear that he does not expect to have a path to use the “nuclear option” to set a new precedent to stop a trial with just a simple majority, effectively bypassing the rules.

Speaking on CNBC, the Kentucky Republican was dismissive of speculation that he might try to change the rules to stop the impeachment process.

“The Senate impeachment rules are very clear,” McConnell said.

Can you state in 1 sentence the specific collusion crime the Mueller Report found Trump committed?

I can't. There's lots of there there, but no clean, direct line that can be explained simply and concisely.

But I can describe in one sentence at least one crime Trump committed vis a vis Ukraine: the president of the United States asked the President of Ukraine to provide him dirt on a political opponent in return for his performance of an official act. Bam.

That's a major difference. BUT the Mueller report wasn't for naught. It provides a boatload of information that fills in gaps and backs up the Ukraine narrative. It just was too difficult to pull a narrative out of it alone.

A sure sign the release of the Mueller report wasn't the right time to start impeachment but now is:

The Mueller Report, while damaging, was a mere and easy to contain puddle compared to the cascading waterfall of revelations that's about to engulf Trump. It just didn't - and, given its limited scope, couldn't - have the volume, breadth, weight, and simplicity that the Ukraine scandal has.

Now the floodgate has been opened, a torrent has been unloosed, and it can't be managed and manipulated by a shameless president, a crooked Attorney General and a crowd of hapless, spineless Republican legislators.
