(115,683 posts)7. Depends on the law of the state, but in my state (Minnesota)
you have to charge first-degree murder by grand jury indictment; and so the initial charge is almost always going to be second-degree murder, by complaint. It can get upgraded by indictment later if the evidence supports it.

Probably did not intend to kill specifically the victim. Can always upgrade charge to first.
