(6,524 posts)Christine Wormuth, Secretary of the Army, subject to the direction of Austin Lloyd, Secretary of Defense (civilian, but currently one with a waiver,) can reactivate him. All of this is subject to the will of the President. It is absolutely doable, in order to bring him under the UCMJ. But, Article 2 says that retirees are subject to the rules contained in the regulations, anyway. Retirees do NOT have unlimited freedom to advocate overthrowing the US Government. Whether they like it or not, they have somewhat reduced freedom of speech. The military can court martial retirees if what they have done is severe enough.
So, I would like to know what is considered to be behavior awful enough to merit a court martial. I think making a speech to rabid fans stating that an armed rebellion should happen here to our government just fits the bill. But, that's just me. The Orange Man stood in front of the hordes and told them that he would lead them in their efforts, which they then attempted. He got away with that thanks to the GOP. What rats. This guy will get away with it, too. The Repubs are quite the show.
Flynn isn't protected. He might get away with it, however, because people are reluctant to do anything, for whatever reason. I don't think his pardon extends to fomenting an armed rebellion. "I was just joking," is the main excuse. Time for that stuff to end.
